Agreement

These Terms of Use (“Terms”) govern your access to and use of www.baleshealth.com and related online materials (the “Site”) operated by Salon Bales LLC d/b/a Bales Health Systems (“BHS,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Who we are — role separation

BHS is a healthcare management / management services organization (MSO). We provide management, CRM and care-assistance tooling, and program distribution services.

BHS does not itself provide medical, nursing, or other clinical care. Clinical care is furnished by independently licensed practices (such as Salon Bales PC) and partner clinical networks. Nothing on this Site creates a provider–patient relationship with BHS, constitutes medical advice, or replaces consultation with a licensed clinician.

Informational use only

Content on the Site is for general business and informational purposes about our management services and partnerships. It is not a solicitation for clinical services by BHS and may be updated or corrected without notice.

Acceptable use

You agree not to:

• Use the Site in violation of law or these Terms, or for fraudulent or harmful purposes.
• Attempt to gain unauthorized access to systems, scrape the Site in an abusive manner, or interfere with security or availability.
• Misrepresent your identity or affiliation when contacting us.
• Copy, redistribute, or commercially exploit Site content except as expressly allowed by us in writing or by applicable law.

Intellectual property

The Site and its branding, text, graphics, and other materials are owned by BHS or its licensors and are protected by intellectual property laws. Limited personal, non-commercial viewing is permitted. All other rights are reserved.

Third-party links and partners

The Site may reference partner platforms, practices, or external resources. We are not responsible for third-party sites, services, or clinical care delivered by others. Separate agreements may govern actual MSO, partnership, or employer arrangements.

No warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, BHS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BHS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

Indemnity

You agree to indemnify and hold harmless BHS and its affiliates from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.

Privacy and communications

Our Privacy Policy describes how we handle personal information. SMS and similar messaging are governed by our SMS Terms.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Exclusive venue for disputes arising from these Terms or the Site lies in state or federal courts located in Sacramento County, California, except where mandatory law provides otherwise.

Changes

We may revise these Terms by posting an updated version with a new effective date. Continued use after changes constitutes acceptance where permitted by law.
